Last updated: 11 August 2026. These terms apply to the fixed-scope, bookable offers listed below.
These Small Project Terms apply to the fixed-scope, bookable offers in Schedule 1. They do not apply to the Partnership Retainer, Website in a Week, Custom Build, AI Build, or any other project governed by a separate accepted quote or signed agreement.
By ticking the acceptance box when booking, paying the applicable fee, or attending or engaging in an applicable service, you agree to these Terms and the relevant Schedule 1 offer terms.
These Terms are between Brooke Thomas trading as Brooke Janet (ABN 19 326 040 220) (we, us or our) and the person or business booking an offer (you or Client).
We provide the relevant fixed-scope service described on its booking or sales page and in Schedule 1. The scope is limited to what is expressly included. Work, access, tools, implementation, revisions or support outside that scope are not included and may be quoted separately.
You must provide accurate, current and complete information, attend agreed sessions, make decisions reasonably needed for delivery, and provide any required materials by the stated deadline. You confirm that you have the right to provide any materials, content and instructions you give us.
You are responsible for checking any information, content, draft or asset before you use, publish or implement it. We are not responsible for delays, errors or outcomes caused by incomplete, inaccurate or late information, changed instructions, unavailable third-party tools or systems, or missed meetings.
Fees are in Australian dollars and are exclusive of GST unless stated otherwise. GST will be added to prices and invoices where required by law.
Unless stated otherwise in Schedule 1, payment is due in full at booking and we do not start paid services until payment has cleared. We may accept payment through Stripe or PayPal. You are responsible for any subscriptions, paid templates, stock assets or third-party platform costs unless we agree otherwise in writing.
If you request work beyond scope, we will provide a separate estimate or quote before undertaking it.
Offer-specific cancellation and rescheduling rules are in Schedule 1. Once a session has started, or work has started on a deliverable, services have begun and fees are non-refundable, subject to rights that cannot be excluded under Australian Consumer Law.
If we cannot deliver because of illness, emergency or another genuine circumstance, we will offer a reasonable reschedule or refund any unused fee, at your choice.
You retain ownership of material you provide. We retain ownership of our pre-existing and underlying intellectual property, including methods, frameworks, prompts, templates, processes, code snippets and training materials.
Once you have paid in full, you own the deliverables created specifically for you as part of the relevant service. You receive a perpetual, non-exclusive licence to use our underlying intellectual property only as embedded in or necessary to use those deliverables. You must not resell, redistribute or present our templates, frameworks or other underlying materials as your own standalone product.
Each party must keep the other party's non-public business, personal and technical information confidential, except where disclosure is authorised, required by law, already public through no fault of the receiving party, independently developed, or necessary to engage a qualified subcontractor or professional adviser who is bound by appropriate confidentiality obligations.
We may use qualified subcontractors or professional advisers to assist with delivery, while remaining responsible for the overall delivery of the service. Confidentiality obligations continue after the service ends.
We will provide the service with reasonable care and skill. We do not guarantee revenue, leads, bookings, time savings, rankings, business performance or any other particular outcome. Results depend on your decisions, implementation, market conditions and factors outside our control.
Nothing in these Terms excludes, restricts or modifies rights that cannot lawfully be excluded under Australian Consumer Law. To the maximum extent permitted by law, we are not liable for indirect, consequential or special loss, loss of profits, loss of opportunity, loss of data, or loss arising from third-party platforms or your use or implementation of a deliverable.
To the extent permitted by law, our total liability connected with an offer is limited to the amount you paid for that offer.
We may end the service if you do not provide information, attendance or cooperation reasonably needed to deliver it. In that case, we may deliver work completed to date and retain or invoice a fair amount for work already performed, subject to Australian Consumer Law.
Neither party is responsible for delay or failure caused by events outside reasonable control, including serious illness, natural disaster, internet outage or major third-party platform outage. If a dispute arises, either party must notify the other by email with the issue and proposed resolution. The parties will try to resolve it in good faith. If unresolved after 28 days, either party may exercise its rights at law.
These Terms are governed by the laws of Queensland, Australia. For questions about these Terms, email info@brookejanet.com.au.
